By booking services with Keeping It Kontained, you agree to the following terms:
Welcome to The Digital Brand Suite (“Company,” “we,” “our,” “us”). By accessing or using our website, services, or content, you agreed to these terms and conditions. If you do not agree, please do not use our services.
Services Provided
We provide creative and digital services, including, but not limited to, content creation, graphic design, and web design (“Services”). These services may be delivered virtually to clients worldwide.
Photos & Media Release

By using our services, you grant The Digital Brand Suite the right to take and use photographs, videos, or other media of the work provided for marketing, promotional, and portfolio purposes.

Any media used will not disclose confidential or sensitive information.

If you do not want your project featured publicly, please notify us in writing prior to project completion.
Payments & Refunds

A non-refundable 50% retainer is required before work begins. This retainer secures your project date and covers initial preparation.

The remaining 50% balance is due before the final deliverables are provided.

Payments are processed securely through Square.

Due to the nature of digital and creative services, all payments are non-refundable once work has begun. In rare cases where work has not started, a refund may be considered at our discretion.
Changes & Adjustments

Each service package includes a set number of revisions as outlined in your project proposal or agreement.

Additional revisions beyond the included amount will be billed at our current hourly or per-revision rate.

Requests that change the original scope of work (also called “scope creep”) — such as adding new features, pages, or design elements — will require a separate quote and payment before work continues.

We reserve the right to decline revisions that contradict the agreed-upon project direction or are requested after the project has been finalized and delivered.
Client Content Submission

You may be provided with a private “Depo” account and access code to submit your content.

You are solely responsible for ensuring that any content you submit does not violate copyright, trademark, privacy, or any other applicable laws.

You grant us a limited, non-exclusive license to use submitted content solely for the purpose of delivering your project.
Intellectual Property

All original designs, materials, and content created by us remain our intellectual property until payment is received in full.

Upon full payment, you receive a non-exclusive license to use the final deliverables for personal or business purposes as agreed.

You may not resell or redistribute our work without written permission.
Limitation & Liability

We are not liable for any damages, loss of data, loss of profits, business interruptions, or outcomes related to the use of our services or website. This includes—but is not limited to—loss of revenue, sales, or customer engagement resulting from any project we complete. While we aim to deliver high-quality designs, branding, and websites, we make no guarantees regarding your sales, income, or business performance after project completion. Our total liability is limited to the amount paid by you for the services in question.
Termination
We reserve the right to terminate services for any violation of these terms, abusive behavior, or unlawful activity.

All official communications regarding your project should be sent to hello@digitalbrandsuite.com.

Email is our primary and official form of communication. We do not guarantee responses to messages sent through social media, text, or other channels.

If you need to speak with us directly, you must book an appointment through our designated scheduling link or call the official company phone number provided to you after booking.

Personal phone numbers are not to be used for business matters. Any business-related phone calls must be made to the company number only.

We respond to client emails within 24 hours during regular business days (Monday–Friday). Messages received after hours or on weekends will be addressed on the next business day.

Any important notices related to these Terms or your project must be sent by email to be considered valid.
Project Completion and Client Approval

Upon completion of the project, we will provide you with the final deliverables for review.

You agree to review the deliverables within 7 business days and provide your approval or any final revision requests within that timeframe.

If no response is received within this period, the project will be considered approved and complete.

Final payment is due upon approval and before the delivery of all final files or transfer of ownership.
Confidentiality
Both parties agree to keep any sensitive or proprietary information shared during the project confidential and not disclose it to third parties without prior written consent.
Force Majeure
Neither party shall be held liable for any failure or delay in performance due to causes beyond their reasonable control, including but not limited to natural disasters, internet outages, acts of war, or government actions.
Client Responsiblities
You agree to provide all necessary information, materials, and approvals promptly to avoid delays. Failure to do so may affect project timelines and deliverables.
Delivery Timeline
We will provide estimated delivery dates, but these are subject to change based on client responsiveness and unforeseen circumstances.
Indemnification
You agree to indemnify and hold harmless The Digital Brand Suite from any claims, damages, liabilities, or expenses arising from content you submit or your misuse of our services.
Severability
If any provision of these Terms is found to be unenforceable or invalid, the remaining provisions will remain in full force and effect.
Entire Agreement
These Terms, together with any written agreements, constitute the entire agreement between you and The Digital Brand Suite and supersede any prior agreements or understandings.
Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to its conflict of laws provisions.
Changes To Terms
We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our services after changes constitutes acceptance of the updated Terms.
